Collective Labor Agreements
Our Labor and Corporate Immigration department’s attorneys possess significant expertise, and extensive experience, in the field of collective agreements, including the representation of clients in industrial disputes.
The department provides comprehensive legal counsel to employers whose organizations are currently (or in the future may be) subject to the terms and conditions of a collective agreement. In this regard, we accompany the employer in its negotiations towards concluding a collective agreement; advise on drafting the agreement; and provide ongoing counsel and representation before labor courts regarding actions arising from the interpretation of collective agreements, or from strikes, injunctions, labor disputes and corporate restructuring.
In addition, the department guides employers throughout the pre-collective stage, including the initial organizational stages.
We also represent unions operating under a collective agreement, providing them with ongoing legal counsel. This representation includes supporting the union’s negotiations with the employer; providing legal opinions on the interpretation of a collective agreement; advising on possible amendments to a collective agreement and given the need, declaring a work dispute, strike or other industrial action.
The department’s attorneys provide full litigation support to our clients relating to collective disputes, and to the filing of actions claiming breach of the terms of a collective agreement, including collective injunctions relating to strikes, allegations of collective agreement violations, and more.
